It Is Impossible To Use The Same Property Twice To Obtain Citizenship – New Rules In The Law
/The Turkish government has amended the Guideline Regarding the Regulation on the Application of the Turkish Citizenship Law. Now, the single property can only be used once to obtain citizenship. This also applies to investors who acquire citizenship through the Citizenship by Investment (CIP) program.
According to the new rules, which were published by imidaily on their website, objects that are the subject of sales contracts or preliminary sales contracts:
Must not be registered in the land registry on behalf of foreign real persons, including the foreign person’s spouse or children.
Should not be among the properties transferred to a Turkish citizen/company after 12.01.2017 by the foreign real person who wishes to acquire citizenship, or its spouse and children, or by a foreign real person of the same nationality.
However, if the property registered in the name of a foreign individual is transferred to a Turkish citizen/company after 12.01.2017, a foreign individual of a different nationality can obtain citizenship with the said property.
Real estate acquired by a foreign individual under a sale and purchase agreement or a preliminary sale and purchase agreement are not subject to registration:
On behalf of the company where the foreign real person himself/herself, his/her spouse and children is a partner or manager.
On behalf of the company subject to Article 36 of the Land Registry Law (with foreign/international capital) where same nationality real person is a partner.
Once a property has been used to acquire citizenship through a transfer of title or a preliminary contract of sale, the same property or any share of the property cannot be used to acquire another citizenship.
